GENERAL SALES CONDITIONS
Colorix Online Sales presuppose the acception of the following General Sales Conditions:

When placing an Online Order, the client automaticaly accepts the following Sales Conditions:
2. Orders and Order Confirmations
Online Orders may only be placed by persons over 18 years. An order can only be placed, provided a personal user account already exists or is opened on the web site of Colorix (www.colorix.com). Each Online Order is binding and deemed as signed document of a business transaction. The client receives his order confirmation by E-mail, listing all items and charges for packaging and shipping cost.
3. Acceptance of Order
Upon placing his order, the client accepts to check his order confirmation available on his user account under (www.colorix.com). In case of any difference the client shall immediately - and no later than within 48 hours - report by E-mail such difference so that a correction can be made prior to shipping. Colorix SA is not obligated to respond to demands received after 48 hours upon acceptance of the order confirmation.
4. Non Liability
Colorix SA can not be made liable for damages or losses caused by Online Sale process or the Internet i.e. loss of data, attacks, viruses, turbulences or interruptions of the net, abusive use or interference into the infrastructure by a third party. Colorix SA warrants the function of its Online Sale within the security standard provided by the net. Colorix SA can not be made liable for defaults caused or related to any of the above mentioned risks.
5. Sales and Payment Method for Switzerland
Sales Prices and General Sales Conditions are part of the published Online Price List. Both are valid and binding at the time of the order. Colorix SA retains the right to change its prices and conditions at any time and without any prior notice. All Sales Prices are displayed without VAT. Online Orders can only be paid by credit card using a safety system. The customer's credit card account is debited after the order confirmation and the downloading of the user account accessable under www.colorix.com.
6. Sales and Payment Method for Export
EU Online clients with a delivery addresse within the EU will find under www.colorix.com the valid Export Price List where the VAT has been exempt. On delivery DHL will charge the client for the import turnover tax (same as VAT of the respective country). All other charges i.e. packaging & transport were already included in the Order Confirmation and paid for.
7. Order Acceptance, Delivery & Complaints
Using Online Sales the client is obliged to immediately inform Colorix SA by E-mail of any mistake in the Oder Confirmation when downloading the document from his personal user account. Colorix is not obliged to respond to complaints reported later than 48 hours after downloading the document.
Online Shipments of regular items will normaly be dispatched within 3 to 5 days upon Order Confirmation. In the event of unexpected delay the client will be informed by E-mail advising him of the new delivery date.
On receipt of the goods, the client is obliged to immediately check that he received the correct and all items in perfect functional condition. Complaints must be reported by E-mail no later than within 8 days of receipt of delivery. Any return of defective items will only be accepted upon prior written consent by Colorix SA.
8. Partial Invality
Should one or more of the conditions contained herein become invalid, non-compliant with the applicable Law or otherwise become obsolete, all remaining conditions shall continue to stay in force and will not be affected. In the event that a condition becomes invalid, it shall automatically be replaced by the respective legal condition.
9. Data Protection
Colorix SA commits itself to respect and keep the data protection according to the Swiss Law.
All personal dat provided by the client will be treated confidentially and not be passed on to any third party - except information essential for the execution of the order (i.e. transmission to Datatrans).
The customer can change his personal data at any time under ''Your Account''.
10. Applicable Law and Court of Jurisdiction
The above General Sales Conditions are in harmony with the Swiss Obligation Right; other conditions i.e. UN international sales regulations are expressly exempt. Court of Jurisdiction is the Court of Neuchâtel, Switzerland, where Colorix SA is registered as company.
